Phoenix Surf Update
Dear PS members,Refund process has started, it appears. However, until the money is in members' egold accounts, they can make as much claims as they like. Autosurf Dummy is not convinced of their ability to make refunds. By the way, here is a damning report on NME's integrity (found at one of the forum) which further confirms the fact that Phoenix Surf and NME are outright scams.

Found something interesting I would like NME's comment on.Absolutely disgraceful to pass off somebody's work as their own. And that is from a multi-million dollar enterprise with a Christian background with "good" ethics and want to help people achieve financial freedom. So kind of them. And what happened to their staff of bright young talents who surely can afford the time, if not to design templates, then at least to paraphrase the site contents.
One of the sites they are launching to try to make money for the company an in turn pay refunds with i suppose is nmedesign.com
On that site you make the following statements...
"NME Design specializes in our creative and innovative website design."
"We have a collection of designs that we have done in the past that we will present to you after finding out your needs."
"Our design team at NME Design cannot be beat. We strive for excellence in everything that we do and do not compromise whatsoever when it comes to the quality of your product. Take a look at some of our web or logo designs in our portfolio by click on the link above to see a good example of just what we can do for you."
"There's no denying the fact that our web design and logo design packages are some of the cheapest around. At NME Design, we want to give you the best deals you can find and the best quality products and service out there. "
This sounds great.... BUT... i found almost all of the templates you seem to imply that your designers did on templatemonster.com, whose terms fobid the use or resale of their products without permission and/or through their affiliate service. Also, their templates are a fraction of the cost.

Also, template monster has a function that allows someone to buy their templates as unique for a certain higher price, meaning they will sell no other of that template after that person buys it as unique. So, if NME were to sell one of these templates to someone after template monster had discontinued it, they would also be violation of more of that site's terms and would be making TN's unique template purchase a waste of money for their customers.
Have a couple of questions and concerns...
1. Has NME acquired the rights to these templates from Template Monster?
2. Why is NME representing these templates as their own design work?
3. Why is the pricing so much higher if the 'original designs' are actually templates?
4. If you have a team of designers who have tons of experience as the site says, why not have real original work samples and why not design the sites from scratch. Last time I checked 'innovative' didn't mean using stock design templates.'
You are also majorly underestimating the intelligence of your members and potential customers. Would anyone really pay 5 times the price for something they could do themselves for a fraction of the price in 15 minutes.
And my major concern is why the pretense. If you are not able to be completely honest and professional about something this small how can members expect to believe things that the company says about other major issues.
You guys could be really innovative if you used the skills and talents you have to actually do something unique and quality of your own. But all we keep seeing is rehashing of other people's ideas with a high price tag stuck on it to get downline revenue (i.e. NMEGlobal, Join the Millions, etc.) and they are flopping.
This is very disappointing. If you want succeed and win back your members, please be genuine.

The nmedesign.com and newglobaltraffic.com sites both resolve to servers hosted by Media Temple. NMEDesign is apparently reselling Media Temple's hosting services, which in not uncommon in the hosting industry.
BUT, what is not common nor professional, moral, or legal is copying the text of someone else's website word for word. And that is in fact what NMEDesign has done.

Both sites list a copyright. However, the Media Temple copyright is the only one that is verifiable via a copyright search.
Now, this is the 4th instance of representing someone else. Also, a legal notice on the Media Temple website states, "The (mt) Media Temple (mediatemple.net) web site, including all text, HTML, scripts, and images are copyright 1998-2006. All rights reserved. Any replication, modification, or copy of any part of this website without the prior, written consent of (mt) Media Temple is prohibited. This copyright notice applies to clients, non-clients, affiliates, and resellers of (mt) Media Temple."
OK... this is the second discovered incident of NME using material copyrighted by another company on their website and another instance of the company representing work done by someone else as their own. They couldn't even take the time to correct the languages they actually speak.
This entire NMEDesign appears so far to be a re-packaged version of other people's hard work. What is the NMEDesign staff being paid for?
I just don't understand.
We are supposedly talking about young, determined, business-minded entrepreneurs. People that are asking us to trust and follow their business lead, yet time and time again we find business actions being taken that just are not professional. Let's put aside the obvious disregard for other people's legal copyrights, although that is MAJOR. But if you put even that aide, would it really be that hard for someone on the staff to take an hour to write their own company description. Wouldn't a parent company that was putting serious efforts into creating what they tout to be an innovative web services and creative company insure that things are done right?
Looks like more and more questions and still no answers.
